OFFICIAL RULES (“Official Rules”)
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
DATES OF SWEEPSTAKES: The “WWIA” Sweepstakes (the “Sweepstakes”) begins at 12:00 a.m. Eastern Time (“ET”) on September 11, 2020 and ends at 11:59 p.m. ET on November 11, 2020 (the “Sweepstakes Period”). Entries submitted outside of the Sweepstakes Period will not be accepted or be eligible to win.
ELIGIBILITY: The Sweepstakes is open only to persons who are residents of the fifty (50) United States and the District of Columbia and are at least twenty-one (21) years of age at time of entry (the “Entrant”). Officers, directors, managers and employees of Wounded Warriors in Action Foundation (the “WWIA” or “Sponsor”), and each of its respective parent companies, subsidiaries, affiliates, and related companies, dealers, dealership associations, advertising and promotion agencies, consultants and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such person, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including, but not limited to National Sweepstakes Company, LLC (the “Independent Administrator”), are not eligible to participate. Sweepstakes is subject to all federal, state and local laws and regulations. Sweepstakes is void outside the fifty (50) United States, District of Columbia and wherever else restricted or prohibited by law. Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes. Eligibility will be determined by Sponsor in its/their sole discretion.
HOW TO ENTER: There are three (3) methods of entry into the Sweepstakes:
- Mail Purchase: Tickets will be sent by WWIA to Heroes that we serve, Friends and Donors who are able to purchase or sell tickets. Upon receipt of a ticket(s), Entrant may purchase by sending back the stub of the ticket with money for the number of ticket(s) purchased. The stub of the ticket needs to be completed to include purchasers full name and at least one contact method (address, phone, and email) and sent to “WWIA” 330 Pauls Drive, Suite 215, Brandon, FL 33511 to be received by November 16, 2020 in order to receive one (1) entry per ticket purchased.
- Online Purchase: Entrant may visit https://wwiaf.org/tickets (the “Website”) during the Sweepstakes Period and select his/her ticket selection. Then, complete the purchase by providing contact and payment information and click “Submit” to receive one (1) entry per ticket purchased. All online tickets must be purchased by 11:59:59 p.m. ET on November 11, 2020 to be eligible for entry into the Sweepstakes.
- Mail-In: To receive an entry without purchasing, Entrant may enter as follows: on a plain 3” x 5” card, legibly handprint your first name, last name, complete address, city, state, zip code, telephone number (including area code), date of birth and email address to “WWIA” 330 Pauls Drive, Suite 215, Brandon, FL 33511. Entries must be received by November 16, 2020. Each envelope is considered one (1) entry into the Sweepstakes. Multiple entries submitted by a single Entrant or in the same envelope are void. Entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions will be accepted.
There is no limit to the number of entries an Entrant may receive. Neither the Sponsor nor the Independent Administrator will verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned. Neither Sponsor nor Independent Administrator is responsible for any purchase that is lost, late, misdirected, illegible, postage due or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.
Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, and/or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes. IF there is any discrepancy to the identity of an Entrant, that Entrant will be disqualified. By entering, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and legally binding in all respects. Any person who tampers with the entry process in any way will be disqualified.
WINNER SELECTION: On or about November 18, 2020, three (3) potential prize winners will be selected at random from among all eligible entries received during the Sweepstakes Period. Odds of being selected as a potential Prize winner are based upon the total number of eligible entries received during the Sweepstakes Period. The random drawing and determination of the potential prize winners will be conducted by the Independent Administrator whose decisions are based upon their sole discretion and these Official Rules, and are final and binding in all respects.
First Prize: There will be one (1) first prize of $5,000 cash to be awarded in the form of a check (the “First Prize”) to the official first prize winner (the “First Prize Winner”). The ARV of the First Prize is $5,000.
Second Prize: There will be one (1) second prize of $2,500 cash to be awarded in the form of a check (the “Second Prize”) to the official second prize winner (the “Second Prize Winner”). The ARV of the Second Prize is $2,500.
Third Prize: There will be one (1) third prize of $1,000 cash to be awarded in the form of a check (the “Third Prize”) to the official third prize winner (the “Third Prize Winner”). The ARV of the Third Prize is $1,000.
Total ARV of all prizes is $8,500.00.
PRIZE RESTRICTIONS: No substitution or cash redemption of prizes is permitted. Prizes are not transferable and may not be resold. Sponsor reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable due to reasons beyond the control of the Sponsor. No more than the number of prizes outlined in these Official Rules will be awarded. ARV is as of date of printing of these Official Rules. The difference in value of a prize as stated herein and value at time of award, if any, will not be awarded. Prize winners are solely responsible for all federal, state and local taxes and all other expenses.
PRIZE NOTIFICATION: The potential prize winners will be notified by the Independent Administrator via email or any other available contact source provided at the time of entry following the random drawing (the “Notification”). If the potential prize winner cannot be contacted or does not respond to the Notification, if he/she is otherwise ineligible as determined by the Sponsor or the Independent Administrator in their sole discretion, or if he/she refuses to accept the prize, then such potential prize winner’s chance to win the respective prize will be forfeited and an alternate potential prize winner will be selected from among the remaining non-winning eligible entries received during the Sweepstakes Period, and such alternate potential prize winner will be notified as outlined above until one (1) Official prize winner per prize is determined in accordance with these Official Rules.
To become the Official prize winner, the potential prize winner must comply with these Official Rules, and upon Notification from the Independent Administrator, must complete and return the Required Documents (as defined in the “PRIZE CLAIMS” section of these Official Rules) in order to claim the respective prize.
PRIZE CLAIMS: Except where prohibited, each potential prize winner will be required to complete, execute and return an Affidavit of Eligibility, Liability and Publicity Release (the “Release”) and an IRS Form W-9 (“W-9 Form”) (if applicable) and any other documents required by Sponsor (collectively, the “Required Documents”) within three (3) days from receipt of Notification from the Independent Administrator. If the potential prize winners fails to return the Required Documents within the time period required, or if the Notification is returned as undeliverable, such potential prize winner forfeits his/her right to the prize and another potential prize winner will be selected from among all remaining non-winning eligible entries received during the Sweepstakes Period, even if the disqualified potential prize winner’s name may have been publicly announced. Potential prize winners receiving a prize of $600 or more must report income to the IRS. In the event it is deemed during the verification process that a potential prize winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the prize, such potential prize winner will be disqualified and another potential prize winner will be selected as outlined above. Valid social security numbers will be determined by IRS requirements. If it is determined by the Independent Administrator, in its sole discretion, that a potential prize winner is not eligible or otherwise not in compliance with these Official Rules, the potential prize winner forfeits his/her right to the prize and an alternate will be selected as outlined above, even if the disqualified potential prize winner’s name may have been publicly announced. In the event that a potential prize winner is disqualified for any reason, Sponsor/Independent Administrator shall have no liability or obligation to such individual.
RELEASE/INDEMNITY: By entering and/or accepting a prize, Entrants and/or prize winners hereby irrevocably consent, where lawful, to the use (which may include without limitation modification or alteration) by Sponsor (and its affiliated and subsidiary companies and their authorized representatives) of their name, image, photographs, videotape, likeness, hometown name, biographical information, and voice for publicity, trade, advertising and promotional purposes in all media now known or hereafter developed worldwide, and on the Internet and World Wide Web, without additional compensation, and without the right of review, notification or approval.
By participating in this Sweepstakes, Entrants hereby release and hold harmless Sponsor and each of their respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, dealers, dealer associations, distributors, advertising, promotion, and fulfillment agencies, including the Independent Administrator, consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, redemption or use of a prize.
Each Entrant shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) participation in the Sweepstakes; (b) a breach or allegation which if true would constitute a breach of any of the representations, warranties or obligations herein; and (c) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death and property damage arising therefrom.
GENERAL CONDITIONS: Should any portion of the Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted at the Website. In such event, Sponsor reserves the right to award the prizes at random from among the eligible non-suspect entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
LIMITATIONS OF LIABILITY: Released Parties shall not be liable to prize winners or any other person or entity for failure to execute the Sweepstakes or any part thereof, or supply a prize in whole or in part, by reason of any act of God, any action(s), regulation(s) order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, cyberattacks, earthquake, war, fire, flood, explosion, unusually severe weather, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, event/experience cancellation or delay, or any similar or dissimilar event beyond their reasonable control. The Released Parties are not responsible for: (a) unauthorized human intervention in any part of the entry process or the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes; (d) any printing or typographical errors or other incorrect or inaccurate entry information in any Sweepstakes-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (as applicable); or (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware, software (including Entrant’s particular wireless device carrier network, if applicable), or the website. All federal, state and local regulations apply.
CHOICE OF LAW/ARBITRATION: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF FLORIDA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a neutral one-person arbitration panel located in Brandon, FL.
WINNERS LIST: For a list of prize winners, mail a self–addressed stamped envelope to: “WWIA” Sweepstakes, Winners’ List Request, PO Box 458, Newark, NY 14513 for receipt by December 18, 2020.
OFFICIAL RULES: A copy of these Official Rules may be obtained at the Website during the Sweepstakes Period.
